Description of Service
Dany is an AI-powered personal assistant accessible via WhatsApp and Telegram. It connects to your Microsoft 365 and Google Workspace accounts (email, calendar, files), provides an integrated CRM for managing professional relationships, and delivers proactive briefings.
The service is intended for professional use by individuals aged 18 and over.
Access and Acceptable Use
Using Dany requires:
- An active WhatsApp or Telegram account
- A valid OAuth 2.0 connection to a Microsoft 365 or Google Workspace account
- Explicit acceptance of these Terms and the Privacy Policy
You warrant that you are the legitimate holder of any connected accounts and agree not to use the service for unlawful, fraudulent, or abusive purposes.
We reserve the right to suspend or terminate access for any user whose behavior violates these Terms, without prior notice or refund.
AI Operation and Liability
Dany uses large language models (LLMs) to process your requests. These technologies may produce inaccurate, incomplete, or incorrect responses (a phenomenon known as "hallucination").
⚠️ You are solely responsible for verifying the accuracy of any information generated by Dany before making a decision or taking action. Dany does not constitute legal, medical, financial, or professional advice.
We disclaim all liability for consequences arising from decisions made based on AI-generated responses.
Security and Action Consent
Any write action performed by Dany (sending an email, creating a calendar event, updating a CRM record, etc.) requires your explicit confirmation in the conversation.
You agree to carefully review confirmation messages before approving any action. We cannot be held liable for actions executed following erroneous confirmation by the user.
Personal Data and GDPR
We process personal data in accordance with the General Data Protection Regulation (GDPR — EU Regulation 2016/679) and applicable national laws.
Details of the data collected and retention periods are set out in our Privacy Policy.
Under GDPR, you have the following rights:
- Right of access — obtain a copy of your data
- Right to rectification — correct inaccurate data
- Right to erasure — delete your account and all data via "Delete my account" or from Settings
- Right to data portability — export your contacts as CSV from Settings
- Right to object — object to certain processing activities
- Right to restriction — restrict certain processing activities

Subprocessors and Data Transfers
In accordance with GDPR Article 28, we inform you of the categories of subprocessors we engage to deliver the service:
Transfers outside the EU are governed by Standard Contractual Clauses (SCCs) approved by the European Commission. A detailed list of subprocessors is available on request at dany.openagent@gmail.com.
Intellectual Property
We own all elements constituting the Dany service (code, interface, brand, algorithms).
Data entered by you (CRM contacts, notes, deals, interactions) remains your exclusive property. We acquire no rights over this data.
AI-generated content produced at your request is made available to you without usage restrictions.
Your data is never used to train AI models or shared with third parties for commercial purposes.
Pricing, Billing and Cancellation
Pricing, renewal terms, and refund policy are available on the Pricing page. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand.
Cancellation: You may cancel at any time via "Delete my account" in Dany or from dashboard Settings. Deletion is permanent and results in the erasure of all your data.
Right of withdrawal: Where applicable under consumer protection law (EU Directive 2011/83/EU), you have 14 days from subscription to withdraw without reason by contacting us at the address in Section 14.
Limitation of Liability
To the maximum extent permitted by applicable law, our total liability to you shall not exceed the amounts you actually paid in the 12 months preceding the event giving rise to the claim.
We shall not be liable for indirect or consequential damages, failures of third-party integrations, actions performed by the AI at your instruction and confirmed by you, or service interruptions beyond our reasonable control.
Service Availability
We strive to keep Dany available 24/7. However, no service level agreement (SLA) is guaranteed under the standard offering. We will notify users as promptly as possible in the event of a significant outage.
Changes to These Terms
We reserve the right to modify these Terms at any time. Changes take effect 30 days after publication. You will be notified of material changes by email or through Dany. Continued use after the notice period constitutes acceptance of the updated Terms.
Governing Law and Jurisdiction
These Terms are governed by French law. Any dispute not resolved amicably shall be subject to the exclusive jurisdiction of the French courts, and in particular the Commercial Court of Paris (Tribunal de Commerce de Paris).
Users residing in the European Union retain the benefit of mandatory consumer protection provisions of their country of residence.
